surveyDescriptionIn Re: Discontinuance of Town Highway NO.55 Order The above matter was heard by the Selectman of the Town of Hartland at Damon Hall, in the Town of Hartland, County of Windsor and State of Vermont, at 1:30 P.M. on Saturday, December 22, 1962, In accordance with notice in the following form: “ The Selectman of the Town of Hartland will meet at Damon Hall, in the town of Hartland, County of Windsor and State of Vermont, at 1:30 P.M. on Saturday, December 22, 1962, to hear all persons who may wish to be heard on the question whether the highway described below should be discontinued as a public highway and continued as a trail. Town Highway No.55, which appears to have been laid out by Humphrey Road, Samuel Perkins and Oliver Gallup, Selectman of the Town of Hartland, on September 12, 1799, as shown by the record thereof recorded on Vol. 1, Page 151 of Hartland Road Records and therein described as follows: ‘A survey of a road beginning at Noah Jenney’s shop. From thence S 13 degrees E 20 rods-S 10 ½ degrees W 44 rods – S 32 ½ degrees W 62 rods – S 4 degrees W 31 rods to Windsor line. Laid tow rods wide and surveyed in the middle, on the 12th of Sept. by Stephen Maine.’ The portion of the described road to be discontinued is that portion running from the intersection of Town road No. 56 to the West Windsor line; and that section is to be continued as a trail under the proposal to be considered on the above hearing. Dated at Hartland, in the County of Windsor and State of Vermont, this 6th day of December, A.D. 1962. Sidney N. Hammond Kenneth J.Murphy Selectman of the Town of Hartland, Vermont” A copy of that notice was posted in the Town Clerk’s Office in Damon Hall, and in the store of Clarence and Anne Sleeper known as “The Shopping Center” on December 8, 1962. Copies of the notice were also sent on that day by registered mail to Mrs. Elizabeth M. Jay, and to Mr. Ralph C Welsh and Mrs. Helen M Welsh, and return receipts showing the receipt of the notices were received from them. At the hearing there were present Selectman Sidney N. Hammond and Louis Maxfield, Town Manager Donald A. Frail and Lewis E. Springer, Jr., attorney for the Town of Hartland. Upon hearing the evidence and viewing the premises, it is hereby found that notice was properly given under the statute to the only abutting land owners, namely, Elizabeth M. Jay, and Ralph C. & Helen M. Welch; that the highway to be discontinued, as described in the notice of the meeting, was laid out entirely within the Town of Hartland by sole action of the then Selectman of the Town of Hartland; that the public good and necessity no longer require the continuance of the road as a public highway but does require the continuance as a trail; and that appears to be no objection to the discontinuance of the road and continuance as a trail. Wherefore, it is ORDERED that that portion of town highway No.55 running from its intersection with town highway No.56 to the West Windsor town line is hereby discontinued as a public highway and its continued and established as a trail.
